Terms of Service

Last updated: 14 October 2026

Version: 2026-10-14

1. Who we are

BrainOS is operated by BrainOS HQ, a project run by its founder in Indonesia. We are in the process of registering a legal entity; until then, the founder is responsible for the service. When these terms say "we", "us" or "our", they mean BrainOS HQ and its founder. "You" means the person using the service.

How we handle personal data is described in our Privacy Policy, which forms part of these terms.

2. Eligibility

You must be 18 or older to use BrainOS Cloud. By creating an account, you confirm that you are, and that you can enter into a binding agreement. If you use BrainOS on behalf of an organization, you confirm you are allowed to accept these terms for it.

3. This is a beta

BrainOS Cloud is in private beta. That means:

  • Features may change, break or be withdrawn.
  • The service may be suspended or ended, in whole or in part.
  • Access is granted in batches, and we may decline or pause beta access.

We will try to give you notice before major changes, and before ending the service we will try to give you a reasonable chance to export your data. Please keep your own copies of anything important.

4. Your account and security

  • You are responsible for keeping your password, API keys and session secure, and for activity under your account.
  • You are responsible for the AI apps and MCP clients you connect to your account, and for the access you give them. You can remove a connection at any time.
  • Give us accurate account information and keep your email address current, since we use it for important notices.
  • Tell us promptly at hello@brainos-hq.com if you think your account or keys have been compromised.

5. Acceptable use

You agree not to:

  • Store, share or process illegal content, or use the service for anything illegal.
  • Attack, overload, probe or disrupt the service or other users, including by bypassing rate limits, security or access controls.
  • Reverse engineer, decompile or copy the hosted service, except where the law allows it. This does not limit what the MIT license lets you do with the open-source package.
  • Resell, sublicense or provide the hosted service to others as your own product without our written agreement.
  • Use the service to violate anyone else's rights, including privacy and intellectual property rights.
  • Store special categories of personal data (for example health, biometric, religious or political data about other people) unless you have a lawful basis to do so.

6. Your content

You own the content you and your agents put into BrainOS. We do not claim ownership of it.

You give us a limited, non-exclusive license to host, store, copy, index and process your content only as needed to provide, secure and support the service for you. This license ends when you delete the content or your account, except for copies in backups, which roll off within 30 days.

You confirm that you have the rights needed to put your content into BrainOS. We do not use your content for advertising or to train AI models.

7. AI agent actions

AI agents connected to BrainOS act on your instructions. You are responsible for what your agents write to your workspace and for reviewing their outputs before relying on them.

BrainOS stores and returns information; it does not check whether that information is correct. Nothing produced by or through BrainOS is professional advice (legal, medical, financial or otherwise).

8. The open-source package

The BrainOS npm package (npx brain-os init) is open source and governed by the MIT license, not by these terms. It runs on your machine and does not require an account.

9. Fees

BrainOS Cloud is free during the beta. If we introduce paid plans, we will give you notice first, and nothing will be charged without your consent.

10. Intellectual property

The BrainOS name, logo, this website and the hosted service belong to us. These terms do not give you any right to use them, except to use the service as described here. The open-source code is available under the MIT license.

If you send us feedback or suggestions, we may use them without any obligation to you.

11. Third-party services

When you connect an AI app such as ChatGPT, Claude or another MCP client, your use of that app is governed by its provider's own terms and privacy policy. We are not responsible for third-party services, how they behave, or what they do with the data they receive.

12. Disclaimers

To the extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, including warranties that it will be uninterrupted, error free, secure, or fit for a particular purpose. This is especially true during the beta.

13. Limitation of liability

To the extent permitted by Indonesian law and any other law that applies:

  • We are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill.
  • Our total liability for all claims relating to the service is limited to the greater of what you paid us in the 12 months before the claim, or USD 50.

Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or gross negligence, and nothing removes rights you have as a consumer that cannot be waived.

14. Indemnity

To the extent permitted by law, you agree to cover our reasonable losses and costs (including legal fees) arising from claims by others about your content, your agents' actions, or your misuse of the service or breach of these terms.

15. Suspension and termination

  • By you: you can stop using the service at any time, and you can delete your account at any time from the Dashboard ("Delete account"), either immediately or, if you choose, after an optional 14-day recovery period during which you can cancel.
  • By us: we may suspend or close your account if you breach these terms, or if your use creates a risk to the service, other users or us, or exposes us to legal liability. Where reasonable, we will give you notice and a chance to fix the problem or export your data first.

Sections that by their nature should continue after termination (such as ownership, disclaimers, limitation of liability, indemnity and governing law) continue to apply.

16. Changes to these terms

We may update these terms. Each version has a date and a version id at the top of this page. If we make a material change, we will tell you by email or in the app before it takes effect. Continuing to use the service after the effective date means you accept the updated terms. We record which version each user accepted. If you do not agree, you can delete your account. Updates never count as your consent to optional uses of your data: where the Privacy Policy relies on consent, we ask for it separately.

17. Governing law and disputes

These terms are governed by the laws of the Republic of Indonesia.

If a dispute arises, please contact us first. We will both try to resolve it through good-faith negotiation for 30 days. If that does not resolve it, the dispute will go to the competent courts of Indonesia.

If you are a consumer living in the European Union or the United Kingdom, this does not take away the protection of the mandatory laws of your country, or your right to bring a claim in your local courts where that law gives you that right.
